(a) It shall be unlawful for any person to keep or maintain any hogs, pigs, swine, horses, cattle, sheep and goats and any other farm animals; fowl and rabbits; any warm blooded carnivorous or omnivorous, wild or exotic animal, including but not limited to nonhuman primates, raccoons, skunks, foxes, wild and exotic cats, pit bulls, Rottweiler dogs, Potbellied pigs; any animal or reptile having a poisonous bite; or any vicious dog, or dog that has been known to bite, chase or run after any person or animal within the corporate limits of the City of Clifton, Kansas, without first obtaining a permit therefore from the governing body of said City. No permits will be issued where said animals would be kept within two hundred (200) feet of the property lines of the nursing home.
(b) Any person desiring to keep or pasture any hogs, pigs, swine, horses, cattle, sheep and goats and any other farm animals;, fowl and rabbits;, any warm blooded carnivorous or omnivorous, wild or exotic animal, including but not limited to non-human primates, raccoons, skunks, foxes, wild and exotic cats, pit bulls, Rottweiler dogs, Potbellied pigs; any animal or reptile having a poisonous bite; or any vicious dog, or dog that has been known to bite, chase or run after any person or animal within the City of Clifton, shall file an application with the City Clerk for permission therefore and the City Clerk shall thereupon deliver said application to the City Mayor who shall check said place that said animals are to be kept or shall have the same checked by a designated employee and shall make recommendations to the City Council with said application at the next regular meeting. That if the council shall find that the keeping of the said livestock as set out in the application and the manner of the keeping of the same shall not be offensive, or a nuisance or unsanitary, they shall issue a permit therefore and supply therein the conditions and manner in which such livestock may be kept on the location set out on the application.
(c) If at any time, the Council shall find that any person to whom a permit has been issued for the keeping of livestock is keeping the same in an offensive or unsanitary manner, or detrimental to the health of the people in the neighborhood or the people of the City, they shall revoke the permit issued to said person, but no such permit shall be revoked until after ten (10) days’ notice is given to the person holding such permit and a hearing and thereon before the City Council in which the party may appear.
(d) That nothing contained herein shall be construed to prevent the bringing of any animals to any stockyards or veterinarian for the purpose of sale, shipment, medical care, etc.
(e) Any person violating the provisions of this section shall, upon conviction thereof, be fined in any sum not exceeding the sum of $200.00; each day such violation continues shall be a separate offense. If the fine is not paid within 3 days, animals will be forcefully removed and sold with fine and expenses deducted from proceeds of sale.
